Anytime someone uses your intellectual property (e.g. original ideas, listing descriptions, photographs, videos, reports, blog, podcast), they need your permission.

Copyright notice is nice to have on your intellectual property, but not required to hold copyright. Creating original intellectual property creates your copyright.

Initially to get someone online to stop using your intellectual property, send them a written notice of what intellectual property appears where on their website.

Also, you will notify them to remove your intellectual property and that your written communications are a notification under the Digital Millenium Copyright Act (DMCA). You will also provide them your contact information.

If they do not remove your intellectual property in a timely manner, you will hire a law firm to seek legal remedies such as a copyright infringement action.

These same laws apply to you, so think about obtaining permission before using other people’s intellectual property which may include: photographs, writings, descriptions, videos, surveys, appraisals, inspection reports, or other similar copyrighted property.
