New litigation threat alleging REALTOR® association websites violate CA privacy laws
(NAR is) reaching out regarding a recent trend we learned of whereby (some) REALTOR® associations are receiving demand letters alleging violations of the California Invasion of Privacy Acts (CIPA). The letter threatens a lawsuit and states that association websites employ tracking technology in ways that violate California privacy law. The tactic is not isolated to REALTOR® associations…
Generally speaking, CIPA prohibits the use of surveillance tools such as a “pen register” or “trap and trace device” without the consent of the person being tracked. Plaintiffs are using this law to allege that the use of website tracking technology, such as cookies, pixels, tags, and beacons, without first obtaining consent from the website visitor constitutes an invasion of privacy under CIPA.
