A brief update regarding recent regulatory guidance issued by the South Carolina Real Estate Commission (SC REC) concerning Limited Market Exposure Listings (commonly referred to as office exclusives, pocket listings, or off-MLS listings).
To support our members and ensure state-wide regulatory compliance, we will be adding the SC REC’s voluntary Residential Disclosure and Acknowledgment of Limited Market Exposure Listing form directly to the SCR Forms library.
Key Highlights of the SC REC Guidance & Disclosure Form
- Regulatory Context: While seller-directed limited exposure listings remain legal in South Carolina, the Commission’s guidance emphasizes that broad public marketing generally best serves a seller’s financial interests and aligns with fair housing principles.
- Licensee Responsibility: Any licensee recommending a limited market exposure listing must be prepared to demonstrate that the recommendation was made in the seller’s best interest—not primarily to advance the financial or competitive interests of the brokerage.
- Form Structure: The SCR forms library will include the official SC REC 2-page document, which features:
- Seller Acknowledgments: 11 specific disclosure items confirming the seller understands the risks of limited exposure (e.g., potential for fewer offers, a lower sales price, and dual agency/in-house transaction considerations).
- Brokerage Certification: A section where the licensee certifies whether the seller independently requested the limited listing or if the broker recommended it based on the client’s stated objectives.
- BIC Signature Line: Requires a Broker-in-Charge signature acknowledging awareness of the seller’s selection.
We are adding this form as a voluntary resource to give our members a clear, compliant pathway to document informed consent whenever a seller elects an off-market strategy.

Listing agents, listing BICs, and listing brokerages may consider using this LLR SCREC form (SCRDALMEL) with sellers who want to avoid full market exposure marketing (e.g., MLS, IDX, VOW, and/or Syndication) for a variety of reasons (e.g., privacy, security, negotiating leverage, economic) and understand the pros and cons of this limited marketing strategy (e.g., informed consent).
