Always use SCR391 for beachfront property to get the beachfront disclosures into the contract per state law. SCR391 can be used to create a backup clause and an AS IS contract. If you or your family members are principals in the deal, use SCR391 to disclose. Need extra time for permits and the seller is wary of a long due diligence period, use SCR391. SCR391 can require the seller to disclose the water supply and waste water system and flood issues and isolated wetlands issue in the soil and water test section. There is a seller financing clause and financial information section. Non SC residents can use the FIRPTA clause. There is a hazmat clause that is useful to shift liability from the brokerage.
